Throughout these terms and conditions the disclaimer and the Privacy Policy when we refer to 'we', 'us', 'our', 'the Company', 'Pixel Star Studios' etc. we are referring to www.pixelstarstudios.co.uk and it's respective owners. When we refer to ‘you' we are referring to the user or browser of this website.
Pixel Star Studios will not be held liable for any loss or damages caused by the use or misuse, unavailability or removal of services.
When your account is closed, all will be deleted. Pixel Star Studios reserves the right to cancel your account at any time without notice.
Pixel Star Studios reserves the right to amend and update these Terms and Conditions at any time without prior notice. To protect your privacy Pixel Star Studios will never distribute your name or e-mail address to any third parties. By logging into your account, or uploading files to it, you are indicating your acceptance of these Terms and Conditions.
Cancellation and Refunds
If you purchase an annual package you are expected to commit for this period of time. If you cancel your account within your service period then Pixel Star Studios reserve the right to disallow any refunds. If you do wish to cancel your services at this website you may do so and you are under no obligation to continue using our services.
Pixel Star Studios reserves the right to cancel your services at any time. Customer refund requests are to be sent to info [ at ] pixelstarstudios.co.uk and will only be processed in the cases of service non-performance where Pixel Star Studios is clearly at fault. Refund requests for problems beyond our control will be refused.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold Pixel Star Studios harmless from any and all demands, liabilities, losses, costs and claims, including reasonable solicitors fees asserted against Pixel Star Studios, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless Pixel Star Studios against liabilities arising out of:
- (1) any injury to person or property caused by any products sold or otherwise distributed in connection with Pixel Star Studios equipment.
- (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party.
- (3) copyright infringement.
- (4) any defective products sold to customer from Pixel Star Studios's diverse partner base.
Disclaimer
Pixel Star Studios will not be responsible for any damages your business may suffer, Pixel Star Studios makes no warranties of any kind, expressed or implied for services we provide. Pixel Star Studios disclaims any warrantor merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, viruses and any and all service interruptions caused by Pixel Star Studios and its employees.
The Purchasing of Goods
The customer is responsible to Pixel Star Studios for ensuring the accuracy of any orders.
The customer is responsible for written confirmation of orders placed; any errors made on verbal orders can only be rectified at the customers expense.
The customer indemnifies Pixel Star Studios in full against all loss (including the loss of profit), costs, damages, charges and expenses incurred by Pixel Star Studios as a result of cancellation of a order; any such cancellation must be informed to Pixel Star Studios in writing. No variation to the Pixel Star Studios Terms and Conditions of Sale shall be valid unless agreed in writing.
In the event of increased cost to Pixel Star Studios , we reserve the right to increase prices to reflect this prior to shipment or provision of goods or services and on informing the customer.
Payment terms
Payment forms currently accepted by Pixel Star Studios for payment of goods include cheque, cash, payment through Pixel Star Studios's secure payment gateway for online payments, or else by means of cleared funds (BACS, CHAPS or Bankers Draft) or deposit of cleared funds in our bank account with shipment only on confirmation from our bank unless pre-arranged with Pixel Star Studios.
Any goods supplied on credit will remain the property of Pixel Star Studios until payment has been made with specific terms agreed. If the customer fails to make on the due date, then without prejudice to any right or remedy available, Pixel Star Studios will be entitled to:
Cancel the contract or suspend any further deliveries, or suspend any services to the customer. Appropriate any payment made by the customer to such of the goods as Pixel Star Studios may think fit.
Charge interest at 5% over prevailing base rate on all overdue amounts to recover all costs incurred in case of litigation. A non-refundable deposit of at least 50% of the total order value is required prior to work commencing. The remainder should be paid no later than 30 days after the work is complete. Any bug fixes or minor improvements are covered in your after-sale support and should not give cause to with hold payments.
Miscellaneous
Each party shall treat as confidential all information obtained from the other. These conditions shall be governed by British Law.
Any claims against shall be brought in the English courts. Pixel Star Studios reserves the right to bring proceedings against you in either the English courts or in the courts of the country in which you are domiciled.
